But the jury didn't buy it. Neither did Oglesby. He accused the prosecution of having too many suspects in the case and changing aspects of the case to fit the investigation. "This was about as close as I've been to a Perry Mason moment," Oglesby said after the trial. Meyers said evidence against Garcia is weak, and that a fourth person, Mario Montano, whose car the gun was found in, passed a polygraph test.

An hour into deliberations, the jury came out of chambers and asked Sargeant if someone could be found guilty of murder for being present at the scene. Sargeant instructed them to go back and restructure the question specific to Sandoval's case. The next time the buzzer rang 30 minutes later, the jury had a verdict. "The judge more or less answered our question the first time," a juror said. Although someone can be convicted in a murder case for aiding and abetting, Meyers said, Sandoval's case was presented in a way specific to who did the shooting.

"Our theory was Sandoval was the trigger man," he said. Sandoval will be transported back to prison in Marion, where he is serving a maximum 25-year prison sentence for an unrelated conviction on robbery and abduction charges. Continued From A1 witnesses led them to the verdict. "There were a lot of doubts with jury members. The prosecution didn't present enough evidence," a juror said.

Prosecutor John Meyers said he was not surprised by the verdict. "We put on the best case available to us, but some of our witnesses got confused, and some of our witnesses did not say in the courtroom what they told us outside the courtroom," Meyers said. The trial's outcome could affect the status of charges against a second person in the case, Julian Kiser, 20, Fremont. Meyers said he has made no decisions about whether he will take Kiser to trial, but was not optimistic. "We did Sandoval's case first because we had better evidence against Sandoval than Kiser.

Obviously if we couldn't convict Sandoval, I'm not too encouraged about Kiser," he said. Fremont police Det. Sean O'Connell said during testimony there were actually three suspects in the case Sandoval, Kiser, and a third man named Jose Garcia. The prosecution tried to prove Sandoval and Kiser went to the High Street house that night and Sandoval shot Rivas five times. Garcia, they claimed, was the behind-the-scenes man that gave Rivas money then threatened Dr.

The man said this was not a tape, but the scene as it was taking place and the television was hooked to a VCR.

The man told his son and future daughter-in-law, as well as her mother, but did not speak with anyone further, records say. The wedding took place as planned. The second person told police the reverend had made comments to him within the last 60 days about encouraging members of bridal parties not to wear bras under their gowns, the affidavit says. And a third person, who left the church because of differences with DeVos, told police she found undergarments missing from her bedroom. This woman also said she traced numerous hang-up phone calls to the church via caller ID.

Danbury Police also searched the church on March 21 and found electronic equipment and sheet music reported as missing from Seybert United Methodist Church in Bellevue where DeVos provides counseling services, reports say. The president of the St. Paul's Lutheran Church congregation, who gave his title but would not give his name, said DeVos has not been preaching since the felony charge was filed, and several other pastors from the area are filling in. Pitzer said the search was not timed to happen on a church holy day but that the evidence just came together at that time to obtain the warrant. DeVos accused of 'peeping' in search warrant ANN MILANOWSKI Staff writer PORT CLINTON The pastor of St.

Paul Lutheran Church in Danbury Township, who is currently facing a felony theft charge, is now being accused of watching women and girls undress as they prepared for weddings. Danbury Township Police Friday spent four hours searching the church and residence of the Rev. Douglas DeVos, 541 S. Church for video and audio taping equipment. Although the peeping allegation contained in the search warrant is six years old, the informant said he came forward after reading about DeVos' run-in with the law over the burglary charge, Danbury Police Chief Steve Pitzer said.

Among items seized were a videocassette recorder and computer said. A complete list will not be available until it is filed Monday in Ottawa County Municipal Court. This information will then be compiled and sent to the grand jury for review. The News Herald attempted to reach DeVos for comment at his home via telephone but an unidentified man said he was not there. The search warrant from municipal court resulted from accusations by three separate persons who contacted Pitzer last week after hearing about DeVos's arrest March 19 on a second-degree felony theft charge in connection with a March 7 incident at a township home.

According to the search warrant's affidavit, on Thursday, an Erie County resident claims he was in the pastor's office on Oct. 5 1991 when he turned on a television set and saw his future Ad paid for by GALLON TAKACS law firm.
